Labor law concern

A few months ago my brothers girlfriend was pulled over and was arressted for a DUI. Now i find out that she had some stuff on her too.  She made a deal with the prosicuting attorney so that she wouldn't loose her drivers lisence. She was giving first offenders status for the possession (and would dropped after one year if she test negative for 12 months) and 18 months restirced lisence and the refusal was dropped. She is a federal employee and was told that she didn't need to report the arrest until her backround check comes around. Well just past week she has been told that she was underinvestigation for the arrest. She was asked why she didn't report it to anyone and she said that the employee hand book says nothing about her having to report anything to anyone. She also told them that she is charged with possession and not convected of one. So now of course she is freaking out about loosing her job. I don't think that she will loose it but no one ever knows what could happen, right. I was hoping that there was some one on this site that knows a little about labor laws and could pass me a couple of words of wisdom.

My brother and his girlfriend when out Saturday night. She drove home because she hadn't been drinking and it was late ( ). She's not use to his 91 Lx, so as she pulled out from a 2 lane road on to an 8 lane blvd (4 in either direction) she almost turns in to the on coming traffic while trying to shift and turn. She corrected her self and gets going. Well in the opposite there was cop coming, well he turned around and started following then (of course). About a mile down the road the lights come and they get pulled over. Cop comes up asked for the normal stuff and walked back to his car. He came back up and asked her if she had been drinking, she said no. He asked her to get out of the car and started giving her a sobriety test. She get anxiety attacks and was having one as he started the testing. anyway she does all the test while having an anxiety attack. She failed one test (follow the pen test). he then told her that he wanted her to take a breathalyzer test. Her anxiety attack was so bad she said no. she was arrested and told that she would have to give one at the station. He got my brother out and aske if he had been drinking which he answered yes. he gave him one test (follow the pen) and told him that he was good to go after he checks the car. The cop opens the door and sits in the passanger side and starts going through her purse. As he's doing that he tells my brother that she wasn't been combative, followed instructions but he had a question about the dartiness of her eyes. When she got to the station she wasn't giving the chance to give blood or take the breathalyzer test. She not only charged with the DUI but also charged with refusal to take the test. if that sticks she is going to loose her license for a year.

 

My question for a cop or anyone that has had something like this happen to them is. Will this hold up in court? What did he do wrong and what did he do right? They also told me that the didn't even tell them why he was pulling them over.

for all the people who have been or are in the military or now how it works. you know it is always great to hear that you have made the next paygrade. Yes that would be me. I am now and E-6 or a 1st class petty officer. Now on to E 7.
